US Immigration Ruling: Ken Ofori-Atta's legal team reacts to OSP's allegations

Frank Davis, lawyer for former Minister of Finance, Ken Ofori-Atta, has argued that a recent ruling by a United States immigration judge has cast doubt on the strength of the Office of the Special Prosecutor's (OSP) case against his client.

Speaking on Asaase Radio's The Big Bulletin on July 22, 2026, Davis maintained that the judge's assessment of an affidavit filed by the OSP exposed what he described as weaknesses in the evidence underpinning the corruption allegations against the former minister.

According to Davis, the US court found that the affidavit contained "conclusory allegations" and lacked sufficient factual evidence to establish criminal wrongdoing.

"This is a significant victory because the court looked at the allegations and the evidence presented and came to a conclusion," Davis said.

He stressed that criminal cases must be built on evidence rather than accusations.

"The issue is not about making allegations. The issue is whether there are facts to support those allegations," he said.

While describing the ruling as an important legal development, Davis clarified that it does not automatically mean Ofori-Atta has been granted a US green card.

He also addressed the belief that the recent development had completely dismantled the OSP's case.

"It is tough for me to say that it means they don't have a case," he stated, adding that the matter remains subject to ongoing legal processes.

The Office of the Special Prosecutor (OSP) has, however, rejected suggestions that the US immigration ruling exonerates Ofori-Atta.

It has maintained that immigration proceedings in the United States are separate from criminal investigations and prosecutions in Ghana.

Ofori-Atta, who served as Finance Minister under the previous New Patriotic Party (NPP) administration, is under investigation by the OSP over alleged corruption-related offences, allegations he has consistently denied through his legal team.
