What we all need to understand is that elections go beyond the mere voting process. The fact that on voting day there was no violence or no issues raised by any party does not necessary mean a fair election. Issues of results compilation and other issues must also be taken into consideration. At any rate, the issue before the Supreme Court is not about anyone's comments, including the observers and the international community. The issue is about the Electoral laws and the Pink sheets, period.

The fact that the SC judges overuled the objection means they clearly understood the import of the statement. That was why Bawumia was asked to respond. For those of you who don't understand, one of the purposes of cross examination is to cause the witness to contradict himself and his evidence thus make him lose credibilty before the judges. This not restricted to only the evidence in court, it includes certain positions and statements by him or his party members such as the Campaign manager of the Presidential candidate etc. By denying that he did not hear what Agyarko said does not mean the rest of the NPP members and their lawyers did not hear. Infact Tony Lithur has succeded in this instance in creating doubt about Bawumia. during re-examination the NPP lawyers duty would be to reduce the damage. "The art of Cross Examination" by the late Heward-Mills, and the biography of Sir Patrick Hastings, a renowned English barrister would throw more light on the purpose, and mode of effective cross examination. Tony Lithur appears to have read both.
