The courts determination is traditionally based on the due process clause. There are two aspects of "due process" - (a) procedural due process; and (b) substantive due process. In this particular case, the EC might have done well on the procedural due process but failed on the latter. Substantive due process relates to the reasonableness of the EC's action. I can bet my last dollar that the EC's decision to disqualify PPP and NDP based on a flimsy error will fail on the reasonableness test unless the courts in Ghana chicken out. I rest my case. There so much good sense and reason to disqualify PPP and NDP presidential aspirants. There is nothing flimsy about they being disqualified for deceit , fraud and perjury.

Something just doesn't quite add up here. If the EC gave parties the chance to correct the errors on the forms, what I want to know is, which of the parties came back with corrected forms? Did the three that sailed through not have anything wrong with their forms? The EC keeps contacts for these parties so a call to them followed up with a letter should suffice in informing them of any anomalies with their forms. I heard this on the BBC and quite frankly it felt embarrassing that a party gets disqualified for failing to submit the required number of passport pictures.
